1. General information

This privacy policy applies to all individuals who use our services. We hereby inform you about the nature, scope and purpose of the collection and use of your personal data by our company.

We respect your privacy and are committed to strictly complying with the legal requirements governing the processing of your personal data (EU Regulation No. 679/2016 (GDPR), DSG 2000, DSG 2018 and TKG 2003). All your personal data is processed on this basis.

The data controller is the Krismer family, Fisser Straße 40, 6533 Fiss. By using our services and giving your consent in accordance with this statement, you confirm that you are at least 14 years of age and capable of giving valid consent, or that valid consent has already been given by your legal guardian or trustee.

2. Information pursuant to Article 13 of the GDPR

Your personal data, which includes in particular

• your master data (surname, first name, address, email address, telephone and fax numbers, date of birth),
• the data contained in travel documents (passport number, passport details, date of birth, issuing authority, validity period, nationality) and identity documents (identity card, driving licence, etc., including the issuing authority and validity period)
• data relating to payment methods and in connection with payments, in particular debit cards, credit cards and bank cards,
• the length of stay you have requested, as well as any information relating to your stay that you provide to us, and
• special categories of data, such as health data and data relating to special needs,

are required for our services. This also includes bookings for catering, mountain and ski guides, transfers, tours and events. Furthermore, we would like to point out that our entrance area is monitored by a CCTV camera to maintain security and to protect against vandalism.

We therefore store and process this data for these purposes and, where necessary, transfer it to third parties with whom we collaborate to provide the most effective and best possible service to our customers – this may also include service providers in third countries acting as data processors, as well as software and agency service providers.

The legal bases for these data processing activities are

• the fulfilment of our pre-contractual and contractual obligations towards you,
• consent obtained from you,
• statutory, contractual or other legal obligations on our part (e.g. documentation rights and obligations under accounting, tax and customs law, contract law, reporting requirements and legal disputes), as well as Section 96 of the Telecommunications Act (TKG), and
• our legitimate interests (e.g. improving our customer service, including in the area of direct marketing, or safeguarding our own legal interests).

The duration of storage is determined by the duration of our business relationship, the consents you have given, and, in addition, by the statutory retention obligations and legal obligations applicable to us. We would like to emphasise that, in the event of an ongoing working relationship, we strive to provide the best possible customer service by familiarising ourselves thoroughly with the customer requests you have already submitted to us, so that we can ensure your continued and long-term satisfaction.

3. Our websites

When you visit our website, your access data is automatically collected and stored. This access data may include, in particular, the page accessed, the files viewed, the date and time of access, the user’s IP address, details of the accessing computer (in particular the browser and operating system), as well as the volume of data transferred and confirmation that the page was successfully accessed. We use this access data for internal statistical purposes, to ensure the security of our website and to optimise the service we provide. In the event of a suspected unlawful act, the access data will be analysed to preserve evidence.

By entering your personal data into one of our contact forms, you consent to its transmission to us, and to its storage and processing by us, for the duration of the handling of this specific enquiry. This applies in particular to your enquiries via the contact form and to emails you send to us. We require this data to process your enquiry and, in such cases, will also store your IP address for the purposes of preserving evidence. The data will be stored for as long as is necessary to deal with any supplementary or subsequent enquiries made by you or by us.

The legal bases for this data processing are your consent, our pre-contractual and contractual obligations towards you, our legitimate interests and legal obligations of all kinds, and Section 96 of the Telecommunications Act (TKG).

4. Newsletter

You are free to subscribe to our newsletter. The subscription, for which you must provide your email address and give your consent to receive the newsletter, only becomes effective once you have confirmed a subscription link sent to you by email. In every newsletter you receive, you will find all the necessary information on how to unsubscribe from the newsletter.

The content of our website has been carefully compiled and checked on several occasions; however, we accept no liability for the up-to-date nature, accuracy or completeness of the information provided. Claims for damages arising from the use or non-use of the information, or from the use of incorrect or incomplete information, are excluded. All offers are subject to change and non-binding. We reserve the right to amend, supplement or delete the content or parts thereof without prior notice, or to suspend publication of the website temporarily or permanently.

The content and programming of our website are protected by copyright and neighbouring rights. Any reproduction – including in part – and public communication, in particular the copying of texts, graphics and photographs, is prohibited without our prior written consent.

5. Disclosure to third parties / obligations of data processors

We may, in certain circumstances and in accordance with the permitted purposes of use, transfer your personal data to data processors (e.g. for our electronic marketing in the form of newsletters) as well as to third parties who must be engaged to provide the services you have requested; all such parties have undertaken to us to comply with the applicable data protection standards. Should compliance with European data protection standards not be possible – for example, because standard contractual clauses, adequacy decisions or certifications are not guaranteed in a specific case – we will inform you in good time and also obtain the necessary consents from you.

6. Cookies and tracking services

We use cookies, which are small text files used to store information in web browsers. Cookies are recognised the next time you visit our website and play a significant role in speeding up loading times and making your use of our services more convenient. The information recognised and stored by cookies is used to recognise you, but also to analyse your user behaviour. It is stored on the server of the respective provider, who, as our data processor, has undertaken to comply with the applicable data protection standards.

Your IP address is first truncated within the European Union and is therefore anonymised or, at the very least, pseudonymised. Only in exceptional cases is the full IP address transmitted to a Google server in the USA and truncated there.

Google uses this information to analyse your use of the website, to compile reports on website activity and to provide the website operator with further services relating to website and internet usage. The IP address transmitted by your browser as part of Google Analytics is not combined with other data held by Google. We have implemented organisational and technical safeguards, which we continuously evaluate and adapt as necessary, to protect your personal data stored and processed by us.
